CSL S Weatherford, LLC v. Arens, No. 02-22-00282-CV (Apr. 6, 2023) (Birdwell, J., joined by Kerr and Walker, JJ.).
Held: The trial court did not abuse its discretion by denying Appellants’ motion to dismiss Appellee’s health care liability claims due to her alleged failure to serve them with an expert report as required by the Texas Medical Liability Act, which authorizes service upon a “party or the party’s attorney” even before the filing of a health care liability claim. The record reflects that Appellee accomplished such pre-suit service upon Appellants through their attorney.
