Atmos Energy Corp. v. Paul, No. 02-19-00042-CV (Mar. 5, 2020) (Bassel, J., joined by Wallach, J., and Ruben Gonzalez, Jr., J. (Sitting by Assignment)).
Held: An easement agreement granting the right-of-way and easement to construct, maintain, and operate “pipe lines” over and through a 137-acre tract of land, requiring the grantee to pay the grantor one dollar per lineal rod for each additional line should the grantee lay more than one line under the grant, is a multiple pipeline blanket easement. A grantee’s laying of an initial pipeline under a multiple pipeline blanket easement does not fix the location of all subsequent lines the grantee may lay under the grant in the absence of express language in the easement agreement imposing that limitation.
